Funding your Claim

Public Funding

Public Funding (Legal Aid) was abolished for nearly all injury claims in 1998 and for all clinical negligence claims from 1/4/2013 (expect for a child suffering expect for a child suffering neurological injury arriving during pregnacy, birth or within 8 weeks after birth.)

Consequently nearly all personal injury and most clinical negligence claims are now funded using either Legal Expenses Insurance (LEI) or No Win, No Fee.

Legal Expenses Insurance

You may be able to cover the costs of pursuing a claim if you have Legal Expenses Insurance attached to your motor insurance, household contents insurance or possibly a credit card may have legal expenses insurance attached. Travel insurance may cover the legal costs if you have suffered injury abroad.

You should bring your policy booklet and schedule of insurance to your first appointment. There is no need to contact your insurance company first. We will liaise with them to establish if you are covered.

No Win, No Fee

A 'No Win, No Fee', or Conditional Fee Agreement (CFA), allows you to pursue a claim at no risk to yourself.

We agree not to charge for the work that we do if your claim is not successful. If you win your case, your costs, disbursements and insurance policy premium (see below) will be payable by the Defendant in addition to your compensation.

To protect you against the risk of losing, we arrange “after-the-event” insurance which pays the other side’s costs and your own disbursements if you lose. The cost of the policy is written off in these circumstances meaning that you pay absolutely nothing. Win or lose you do not have to pay the insurance premium.
