£18,000 obtained for client bullied by supervisors

Chris Turner, stress at work specialist at Fosters Solicitors, has obtained a settlement of £18,000 for a client who developed depression and anxiety after being bullied by his supervisors between 2013 and 2015.

Our client, a sufferer of Chronic Fatigue Syndrome (CFS), would often be told that his supervisors were ‘out to get him’ and frequently used negative and disrespectful language about him in front of his colleagues, calling him ‘lazy’ and questioning his ability to carry out his role – despite him receiving many glowing references from colleagues and members of the public over the years.

He initially raised a grievance after suffering for two years, which was partially upheld. The investigation found there had been a breakdown in the relationship between him and his supervisors. However, the allegations of bullying were not upheld, despite over 20 of his colleagues sending supportive emails as part of the investigation process. Our client was then redeployed to a different role despite his wishes to remain in his own role, with no further action being taken against his supervisors.

As a result, our client was diagnosed with depression, anxiety, and an exacerbation of the symptoms caused by his CFS. Fosters successfully pursued a claim for compensation on his behalf.

Commenting on the outcome, Chris Turner said: “This was a particularly complex claim where the defendants strongly denied liability throughout, saying there had simply been a ‘breakdown’ in the relationship between our client and his supervisors. However, we maintained our position that the employer’s conduct satisfied the legal test for bullying and issued court proceedings. The defendants immediately said they wished to negotiate a settlement, and after negotiations damages of £18,000 were agreed. I am delighted to have achieved such an excellent result for our client, who is now able to move on with his life.”
