Compensation Scheme Extended for Victims of Asbestos Exposure

Exposure to asbestos can lead to serious health issues including asbestosis, lung cancer and mesothelioma. The most common cause of exposure to asbestos is coming into contact with it in the workplace, particularly in the engineering and associated industries which were dominant in the UK until the late 1980s.

However, the implications of such asbestos exposure are often not known until many decades later, at which point it can be difficult to pursue a claim for compensation where, for instance, the company has ceased trading.

At Fosters, we regularly act for clients who have suffered negligent exposure to asbestos in their workplace, even when such exposure may have occurred many years ago.

To reflect the fact that many companies are no longer in business or that all the relevant insurers cannot be traced, sometimes the insurers or government put into place a statutory scheme to ensure that those who have suffered injury can be properly compensated.

To compensate claimants who have been exposed to asbestos whilst employed by companies in the UK Federal-Mogul Group (formerly the T&N Group), the T&N UK Asbestos Trust and The EL Trust have been set up with the aim of allowing claimants to receive such a payment. These trusts have now been extended to cover several more companies in that group to allow many more ex-employees to recover compensation.
