Fosters Solicitors secure £100,000 settlement for road crash client

Fosters Solicitors’ Personal Injury team were instructed by Michelle on a no-win-no-fee basis to obtain compensation for a head-on road traffic accident she had been involved in.

The accident left Michelle not only with physical injuries, but with travel anxiety which affected her ability to continue to work. Michelle’s claim ran for almost three years until settlement was achieved in the sum of £100,000.

Michelle’s case

Michelle was driving along a B road in Norfolk when a car heading in the opposite direction swerved onto her side of the road and caused a head-on collision. Michelle was taken to hospital and diagnosed with whiplash-style injuries as well as injuries to her ribs and sternum.

Various reports were obtained by medical experts to comment on the extent of Michelle’s injuries, as it had become apparent that they were not just physical. Michelle had approximately two months off work as a result of her injuries before being placed on a phased return to work. Michelle was still struggling with pain in her neck and had also developed travel anxiety as a result of the accident. The anxiety element meant that Michelle was unable to drive or be a passenger in a vehicle, therefore making it difficult for her to continue to work. Eventually, Michelle took early retirement from her job and was able to claim for loss of future earnings and pension with the assistance of a forensic accountant’s report.

Fosters were able to assist Michelle at every step of the claim by ensuring that all relevant reports relating to her injuries and recovery were obtained, these included reports from a GP, orthopaedic surgeon, psychologist, spinal surgeon and occupational health, as well as securing interim payments to help Michelle with her day-to-day bills. This enabled Fosters to negotiate with the defendant’s insurer and narrow the gap between the defendant’s opening offer of £15,000 and the £100,000 that was finally achieved.
